Fresno County Board of Supervisors, please note: Ex post facto laws are unconstitutional. Article I, Section 9 of both the U.S. and California constitutions, prohibits unfair laws that punish someone for an act that was not illegal when the act was done.
Fresno Bully Rescue bought property that was (and is) zoned to allow for kennels. It has invested additional money and resources into developing that property for that purpose. The county had foreknowledge of the property owner’s intentions to build a lawful kennel, and county staff correctly approved it.
If the supervisors retroactively attempt to disallow that kennel from being built, their action will amount to penalizing the property owner for an act that was legal at the time the land was purchased. The supervisors took an oath of office, and I expect them to uphold our national and state constitutions, as they solemnly vowed.
