A bystander was shot and another man cut in the face Thursday night during a fight in east-central Fresno.

Lt. Mindy Casto said police received a call of subjects fighting in the street around 6 p.m. near Happy Market on the corner of Maple and Shields avenues. One man was found in the market parking lot with a gunshot wound to his abdomen. He was taken to Community Regional Medical Center, where he was listed in critical but stable condition.

Casto said the man who was shot was apparently waiting for a bus and not involved in the fight.

Witnesses told police Robert Aguilar, 35, was the shooter. One witness saw Aguilar and his twin brother, Lee Aguilar, fighting with another man at the apartment complex across Shields from the market. During the fight, Robert Aguilar pulled out a gun and fired several shots. He apparently missed his intended target and hit the bystander, Casto said. Police later learned the apartment complex was also struck by gunfire, but no one else was injured.

Robert Aguilar received a large laceration wound in the fight.

The Aguilar brothers were arrested on various charges, including Robert Aguilar for alleged assault with a deadly weapon. Casto said the identity of the other man involved in the fight is not known.
