Fresno man found guilty of killing man while he slept
A Fresno man was convicted Friday afternoon of first-degree murder in the killing a family man who was sleeping in his van.
The verdict was announced in Fresno County Superior Court after two full days of deliberation.
Kylin Dion Smith, 21, was found guilty in the slaying of 42-year-old Felipe Atilano who was shot in the head during the early hours of Oct. 2, 2011, as he slept in his van parked on Martin Luther King Boulevard in southwest Fresno. The jury also convicted Smith of the attempted robbery of Atilano.
Smith faces at least 50 years to life in prison. His sentencing is pending.
Smith was 17 when the shooting took place. He was tried as an adult because of the seriousness of the crimes.
A co-defendant in the case, Walter Gerard King, who was also 17 at the time of the shooting, has already been tried as adult. In March 2013, he was convicted of first-degree murder in the shooting death of Atilano, the father of five children. King was sentenced to 50 years to life in prison.
