Officer fires rifle at fleeing Fresno man, body cam shows. He had escaped before

Fresno police released a video Friday from a standoff in which an officer fired several rounds at a 23-year-old man attempting to flee arrest.

Andrew Garcia was not struck by any bullets, but was taken to the Community Regional Medical Center after surrendering to police after he complained he was in pain from his car striking fences during his attempt to flee on June 1, according to police.

Garcia pleaded “no contest” to two counts of resisting arrest, and the counts of vandalism and other charges were dropped, according to court records. He is set to be sentenced later this month.

The police video begins on the day before the officer fired at Garcia. Police said Garica was stopped in a car near Butler Avenue and Hazelwood Boulevard on May 31 and gave officers a false name before he fled in the car.

Police were not able to locate him until they found his car about 5:30 p.m. the next day near Turner and Sierra Vista avenues, according to the video.

Officers can be seen in the video knocking on the door to the home and frisking one person, whose face was blurred from the video, before they call for Garcia to come out to them.

An officer standing at the edge of the home saw a screen from a window as it appears to be forcefully knocked out before the officer yells at Garcia to show his hands. Garcia can be heard saying, “I got something” and “I’m loading it.”

He appears to be holding a gun at some points in the video, but police said it turned out to be a replica.

The officers backed away from the home, kept a perimeter but also stood behind police cruisers, the video shows. They then began to try to talk to Garcia.

Surveillance footage shows Garcia on foot trying to escape by jumping fences into neighboring backyards, police said. The 23-year-old at some point got into a car, according to police.

The footage shows a car reversing and appearing to drive away before an unnamed officer fires a rifle at the car four times. Garcia was not struck by any bullets, police said.

More surveillance footage shows Garcia attempting to escape by driving the car through backyard fences and changing directions several times.

Garcia ultimately surrendered to SWAT after speaking to crisis negotiators, police said.

It was the fourth time this year a Fresno officer fired at someone.
