Former Clovis High employee pleads no contest to having sex with student
A former Clovis High employee pleaded no contest Wednesday to a felony charge of having unlawful sex with an underage student.
Dwayne Andrews is the second former Clovis High employee to accept a plea deal in connection with having unlawful sex with a student in 2014.
On June 3, former Clovis High teacher Matthew Pena pleaded no contest to having unlawful sexual intercourse with the same student Andrews was having sex with, court records say.
Court records say the student, who turned 18 in December, told police she became romantically involved with Andrews, a former walk-on football coach and substitute teacher at Clovis High, around November 2013. She told police she had sex with him from May 2014 to August 2014.
Andrews was charged initially with five felony counts of unlawful sexual intercourse.
Under the plea agreement Wednesday, Andrews will get probation and won’t have to register as a sex offender, said Fresno attorney Roger Nuttall, who represents Andrews.
Prosecutors also dismissed the remaining felony sex charges against Andrews in exchange for his plea. In criminal cases, a no-contest plea is equivalent to a guilty plea.
Andrews, who is free on bail, will be sentenced Aug. 19.
Pena taught photography at Clovis High and coached golf and baseball. He played collegiate baseball as a pitcher at University of the Pacific. As a student at Buchanan High, he was a Bee All-Star baseball player in 2000.
His encounters with the 17-year-old student happened between October and December 2014, court records say. He and Andrews were arrested in January this year.
Affidavits say the girl told police she was in love with Pena, had his name tattooed on her side and wanted to have his baby.
The girl, who has not been identified, also told police she had a romantic relationship with Andrews, whom she called “Daddy,” the affidavits say.
The girl had sex with Pena and Andrews at their homes. The student said she first had sex with Pena off campus during a lunch break. She told investigators she had sex with Pena when she lived temporarily with him, his pregnant wife and his young daughter.
Pena, who also is free on bail, will be sentenced July 28. Under a plea agreement, he faces up to three years in jail, but could receive probation because he has no prior criminal record and admitted wrongdoing at an early stage, said Fresno attorney Michael Idiart, who represents Pena.
