A Fresno man was sentenced Wednesday to 11 years in prison after pleading guilty to voluntary manslaughter in connection with the November 2010 killing of his 2-month-old daughter, Perla.
Under a plea agreement, Jorge Arthur Hernandez, 24, waived his right to appeal and gave up four years of time credits in jail, defense attorney Katherine Hart said.
Hernandez has been in jail since his arrest on Nov. 10, 2010, when his daughter was taken off life support at Valley Children’s Hospital.
Prosecutor Ron Wells said the baby died of blunt force trauma. But the baby didn’t have a skull fracture, Hart said, noting that she had bleeding around her brain. If the case had gone to trial, a defense expert was going to testify that Perla had an existing medical condition with her brain and that it was made worse when the child was given the wrong medication, Hart said.

In announcing the sentence, Judge Don Penner said Hernandez has low intellect and gave conflicting statements to law enforcement about the child’s death.
