An agreement averting litigation on the Campus Pointe project at Fresno State was announced Tuesday night between the university, the city of Fresno and Kashian Enterprises, according to Rhonda Jorn, the city's public affairs manager.
The Campus Pointe development is to be built by developer Ed Kashian on 45 acres just east of the Save Mart Center at Shaw Avenue and Highway 168.
It will have 540 apartments, a 200-room hotel and 230,000 square feet of office and retail space, including a 14-screen theater.
Earlier this year, the city filed suit against the project, seeking $322,785 for fire protection, $808,031 for streets, $515,877 for police protection and $1,492,560 for parks.
The city's lawsuit alleged procedural violations of laws governing environmental review of the Campus Pointe project.
The city asserted that because Campus Pointe will be developed by a private company, not the university, it was not exempt from city planning and zoning rules as the university maintains.
In the agreement announced Tuesday, Kashian agreed to pay applicable city impact fees and California State University, Fresno, agreed to provide the city the necessary right-of-way to complete improvements at the Willow-Bullard avenue intersection and a multiuse trail adjacent to Willow, Jorn said in an e-mailed press release.
