A mistrial was declared Monday in the attempted- murder case against a Fresno man accused of shooting a father and young daughter in an apparent case of mistaken identity.
Shalander Givens, 38, of Fresno was on trial in the southwest Fresno shooting of Antonio Skinner and his 10-year-old daughter. The shooting took place on June 25, 2010, when Skinner was driving his car with two children inside at the intersection of Plumas Street and Eden Avenue.
The case was one of mistaken identity, Fresno police said. Skinner's car was almost identical to one driven by a man who was involved in a fight with Givens and his brother five days before the shooting.
The Fresno County Superior Court jury vote was 10-2. Judge Edward Sarkisian asked the jury not to say whether it favored guilt or innocence.
Givens' lawyer, Jane Boulger, said she learned the jury voted 10-2 to convict Givens in juror interviews following the trial.
"I'm really pleased two people stuck to their convictions," she said.
Skinner said he was going to his sister's house to give her money for groceries. He drove to the corner of Plumas Street and and Eden Avenue and came to a stop sign when his 5-year-old son riding in the rear of his car pointed to a party with a bounce house. Skinner stopped and turned to look as a sport utility vehicle drove past them and began firing into the car.
Skinner didn't see who fired at him because he was ducking and holding his children's heads down. Police found 27 shell casings at the scene.
A woman who lived at the corner said she saw the SUV pass and said she saw a man who looked like Givens tucking a gun into the passenger side of the vehicle.
Boulger said her client has a criminal past but was not involved in the shooting.
Givens remains in jail. He is ineligible to bail out. His next hearing is April 18.
