A Clovis woman who accused her estranged husband — at the time a Madera County sheriff’s deputy — of spousal rape has pleaded no contest to assaulting him and his girlfriend in April.

Regina Saldivar, 35, originally faced two felony charges of burglary and inflicting corporal injury on a spouse and two misdemeanor battery charges in Fresno County Superior Court.

In a plea agreement, prosecutors dropped the felony charges last week and she pleaded no contest to two misdemeanors charges, said defense attorney Linden Lindahl, who represented Saldivar in the criminal case. The plea allowed Saldivar to keep her job as a pharmacy technician, Lindahl said.

Her estranged husband, Jerry Saldivar, however, no longer works in the Madera County Sheriff’s Department, said spokeswoman Erica Stuart.

Employment laws prevented Stuart from commenting, other than to say Jerry Saldivar ended his employment at the Sheriff’s Department in November.

His troubles began in March, when Clovis police arrested him after Regina Saldivar accused him of raping her and videotaping the incident while she was unconscious.

The following month, Fresno police arrested Regina Saldivar after she broke the bedroom window of a home where her husband was staying. She hit him and his girlfriend about 3 a.m. April 19, a Fresno police report said.

On July 31, prosecutors dropped the sexual-assault charges against Jerry Saldivar, saying Regina Saldivar had “issues.”

Since then, Regina Saldivar has been fighting to restore her credibility and regain custody of her children, said Lindahl and attorney Timothy Cox, who represents Regina Saldivar in her divorce case.

“It’s totally unfair,” Cox said. “Regina didn’t pursue the rape charge because she loved her husband and thought they would reconcile. She also believed her kids need a father, so she didn’t want him to go to prison.”

But Jerry Saldivar used his estranged wife’s arrest in divorce proceedings to get sole custody of the couple’s two children, Cox said.

According to the Fresno police report, Regina Saldivar said she went to a relative’s home to look for her husband because she believed they were going to reconcile her differences. But when she caught her husband in bed with another woman, she attacked them, the report said.

With her plea, Regina Saldivar was sentenced to three years of probation and ordered to pay a $100 restitution fine.

Jerry Saldivar could not be reached to comment Tuesday. Attorney Richard Beshwate, who represented Jerry Saldivar in the spousal rape case, said the couple “should put their differences aside and just move on for the sake of their children.”
