The former executive director of the Genesis child welfare agency pleaded no contest Wednesday to drunken driving and was given a jail sentence that runs concurrent with her violation of probation.
Elaine Bernard, 49, was sentenced to 30 days in the county jail and 10 days in the Adult Offender Work Program. She also must attend a class for first-time offenders and pay $2,170 in fines.
Her plea to a misdemeanor charge was in connection with an incident on July 25, 2006, outside her Clovis home. Her blood-alcohol content was 0.14%, nearly twice the legal limit of 0.08%, prosecutor Carol Banta said.
After her plea, Bernard returned to jail, where she has been since March 30 for violating terms of her probation stemming from her conviction last year. She was convicted of felony embezzlement and tax evasion.
Prosecutors say Bernard and her sister, Carol Dela Torre, the nonprofit's deputy director, stole tens of thousands of dollars from the nonprofit by using company credit cards for shopping sprees and vacations. Dela Torre was convicted of misdemeanor embezzlement.
As part of their sentences, they were ordered to enroll in work furlough programs with electronic monitoring.
While Dela Torre successfully completed the program, a judge last month sentenced Bernard to at least three months in jail after probation officials discovered she had gone to social events while on electronic monitoring. Under the program, she could only go to work. The rest of the time she had to be home.
Bernard is expected to be released from jail July 23, jail records show.
Bernard's drunken-driving case took a back seat to the Genesis case and was delayed dozens of times because of scheduling conflicts among the lawyers.
Police arrested her and her boyfriend, Ken Steitz, after they drove home in separate vehicles.
According to a police report, Steitz nearly hit a light pole, swerved in and out of lanes and narrowly avoided hitting other motorists. After being pulled over, Steitz said he had not been drinking alcohol, but he had a difficult time walking and nearly fell down numerous times, the report said.
Moments after police put Steitz in handcuffs, another vehicle, with Bernard behind the wheel, arrived.
She parked in the garage and directed an expletive-laced tirade at officers, ordering them off her property, according to the report. She also called a female officer a derogatory name, the report said.
Officers noticed that Bernard also appeared to be drunk, the report said. She swayed while she stood, slightly slurred her words and had watery eyes.
In October, Steitz, a former Fresno City Council member, pleaded no contest to drunken driving in which his blood-alcohol content was 0.24%, or three times the legal limit. He was sentenced to three years' probation and 20 days in the adult offender work program. He also was ordered to attend an 18-month second-offender program and pay a $1,520 fine.
